For night work, in addition to the wage achieved for each hour of night work, the employee is entitled to a wage benefit in the amount of at least 40% of the minimum wage in euros per hour according to a special regulation, and if it is an employee performing risky work, he is entitled to a wage benefit in the amount of at least 50% of the minimum wage in euros per hour according to a special regulation. Night work is work performed between 10 pm and 6 am.
For an employer who, due to the nature of the work or operating conditions, the majority of the work is required to be done as night work, it is possible to agree, if not an employee performing risky work, on a lower wage advantage than under paragraph 1, but at least 35% of the minimum wage in euros per hour according to a special regulation, in:
a) collective agreement,
b) employment contract in the case of a non-union employer who employed less than 20 employees on 31 December of the previous calendar year.
It is possible to agree on a salary with the manager in the employment contract, taking into account any night work. In such a case, the payroll benefit does not belong to the manager.
